Human Rights and Discrimination.
Simply stated, discrimination occurs when two things happen:
- You experience negative treatment within a protect social area, and
- The negative treatment is related to a ground under the Ontario Human Rights Code
Ontario's Human Rights Code prohibits discrimination in the following areas:
- Employment (see our services related to Discrimination at Work, here)
- Goods and Services
- Contracts
- Accommodation (housing)
- Membership in a vocational association
Within these areas it is illegal to treat someone negatively because of a Code ground. Code grounds include things like disability, sex (including pregnancy), sexual orientation, and race.
Discrimination can also happen when you are adversely impacted by a rule, policy or practice. So ask yourself, does this rule (or practice or policy) negatively impact me because of a listed ground? If so, you might be experiencing discrimination and have a right to accommodation.
There are many ways a lawyer can help you address discrimination. A lot will depend on what you are dealing with.
A few things a lawyer can help you with:
- Get accommodation when trying to access housing, or a service
- Help you avoid an eviction if the reason for the eviction relates to a Code ground (i.e. disability, race, etc.)
- Get you damages (money) for the injury to your dignity, feelings, and self-respect the discrimination has caused
- Help improve accessibility with respect to services and housing
